The Best help and the best outcome.
This is a very long story, going back to over a year ago when I was involved in a RTA (road traffic accident) involving a collision with myself in a DPD van and a pedestrian. I was reversing after checking the rear view camera and mirrors, but unfortunately was unable to see an elderly woman in my rear blindspot. The incident happened in a private car park in Rustington. Due to the nature of the incident, and under extremely unfortunate circumstances the elderly woman sustained a few fractures to her pelvis and areas around her leg and lower spine. Throughout this period, I was cooperative with the police and was eventually given a court date for worthing magistrates court. Because I was the driver and because I felt, I felt a moral obligation to plead guilty to driving without due care and attention. I turned up to court and later that day discovered that the CPS had trumped up the charge to "causing serious injury by dangerous driving, which carries a penalty up to 5 years imprisonment and an unlimited fine. This meant that the case had now escalated and was referred to crown court, meaning the matter was all of a sudden far more serious. This saying, I needed a defence. Toby had managed to get the charge amended as this happened in a private area, not a public place as the charge had stated. The charge had then been changed to causing serious injury by furious and wanton driving. Furious speaks for itself but wanton as a definition, signifies an element of intent. "Willful neglect". I assure you that there was no intent in this incident. It was a product of unfortunate circumstances. A catalogue of errors unfolded on that day which could have happened to anyone. Naturally as this case was ready to go to trial I was petrified of how this could impact my life, moving forward, I pleaded guilty on a condition that the court would consider this to be a reckless mistake rather than an intentional act. Throughout this arduous period, I followed suit through the advice offered to me by my solicitor and my counsel. I couldn't have asked for a better outcome. I had a reasonable judge who could see that my actions were accidental and who was also unhappy that this matter wasn't dealt with in the magistrates earlier this year. Toby had come to my rescue and delivered a fantastic result which enabled me to keep my licence and receive a small fine. I can finally rest easy and close the chapter on this event. I would recommend Toby brothers to anyone who finds themselves in a similar situation or something unrelated. He worked tirelessly preparing my defence statement and adopted an approachable and professional manner throughout. Once again......
