Abysmal service.
As a Unite member I was referred to Allan McDougall McQueen (AMM) as I had been unfairly dismissed by my employer for disclosing child abuse etc and received Personal Injuries through stress over this. AMM started Employment Tribunal proceeding and eventually set up a £160,000 Personal Injury case in the Court of Session.
The Solicitor AMM gave the Personal Injury case to David Harris lost track of my case, lost paperwork, ignored my correspondence, wrote to the Union cancelling my funding for the case without discussion, shortly after I complained to him regarding his service, later informing me of his actions and that he and the Advocate Jennifer Nicolson would now be withdrawing from the case after the Advocate had informed me ‘she would do her best for me in court’ and my case had been postponed as it needed more days added.
David Harris’s Supervising Manager/Managing Partner Gordon Bathgate informed me he would review the case when I spoke to him and misled me for six months before ignoring my correspondence just like David Harris had done. I then found out it was too late to hire other legal representation so I had to abandon the case for the time being.
My present Solicitors now inform me my ex-employers Solicitor applied for an amendment when my case was being abandoned that they be absolved of all issues in the case, David Harris did not oppose this and the Judge granted this amendment permanently abandoning my £160,000 case which also led to the vast majority of the issues in my Employment Tribunal being stuck off that David Harris was more than aware of leaving a skeleton of the case with little hope of reasonable compensation or restitution. I was unaware of David Harris actions or the consequences as he had not informed me of them.
The ‘not fit for purpose’ Scottish Legal Complaints Commission/Law Society which was the only organisation I could make a formal complaint to could ‘not find any evidence Allan McDougall McQueen was not working in my best interests’ and fined AMM £200 for lack of communication. It’s more than apparent that the Legal Profession are not able to self regulate themselves so leading to the abysmal service I have described.
