Compromise agreement

Bodrul was generally responsive, but I felt that his attention to detail during the discussions and review of my compromise agreement fell short of my expectations.

He overlooked a key clause in my original employment contract regarding working hours. This detail could have potentially strengthened my negotiating position and led to a more favourable settlement. After the agreement was finalised, I discovered that my previous employer had included working hours slightly above the recommended advisory limits. While I wasn’t looking to pursue legal action, I believe this could have been a valuable point of leverage during negotiations.

When I raised this with Bodrul, his response was simply, “I asked if you were happy with the original contract and you said yes.” However, as my legal representative, I expected him to review the contract thoroughly and highlight any aspects that could impact my position, BEFORE anything was signed by myself.

Thank you for sharing your feedback. I’m sorry to hear that you were dissatisfied with my service, and I appreciate the opportunity to address your concerns. During our consultation process, my role was to review the terms of your settlement agreement and ensure you understood its implications before signing. At no point during our discussions did you raise any concerns about the working hours clause in your original employment contract, nor was this identified as a negotiating point. My question about whether you were happy with the original contract was to confirm your overall acceptance of its terms—which you affirmed. After the agreement was finalised, you queried the working hours clause, and I provided a clear explanation of the legal position: that any potential breach would require evidence of detriment, and the weekly limit is averaged over a 17-week period unless an opt-out was signed. Had this been raised earlier, I would have been happy to explore its relevance to your negotiations. You have been working under this employment contract for a number of years and if this was a concern you would have raised this during the consultation. This was not even raised as an issue with your employer at any point. For the above reasons, it is unlikely to have made any difference in terms of your settlement negotiation. I would prefer to discuss your concerns directly. In the meantime, I kindly ask that you consider updating or removing your review, as it doesn’t fully reflect the service I provide, as evidenced by my consistent 5-star reviews.

I needed help with a settlement agreement and I found this solicitor online, looking for somebody close to where I live. It turned out that distance wasn't an issue anyways. I left a message on their website and received a call from Bodrul in 10 minutes.
