Review
We initially visited around May 2022 when we had been given a court date to attend in regard to a section 172.
My son, the defendant, was charged with not having given driver details on a speeding offence. We had, in fact, never received any speeding tickets (notice for intended prosecution) letters and had no knowledge of the said speeding ticket until a court letter regarding a section 172 arrived at our address.
We discussed with Heather Crossthwaite the fact that our post was not good in our street and she said that she would contact the courts and see if we could get it reversed back to a speeding offence. She seemed, at the time, quite confident that this could happen.
Time was of the essence as the original date for the trial was during my son's holidays that he had prebooked and he would not, therefore be able to attend on the said date. We were getting quite concerned as we had got no closer to sorting this and had little contact with Heather and she was on holiday when we urgently needed to speak to her. However, our case was taken over and handled swiftly when I aired my concerns by Martha and Peter. They managed to get an adjournment and the case was moved forward. After changes of dates we eventually got a date and all evidence and information was sent to Peter for him to build a case. This was all done by email and I do, however, feel that a telephone conversation would have been a more personal approach.
Peter built up a strong case for us and was very honest in informing us that we were "up against it" as the law wasn't on our side in this matter. However, the magistrates understood our case and showed empathy towards us and therefore believed what was the truth and we managed to rebut the presumption of service of the Notice for intended prosecution and therefore win our case.
There was a large amount of discussion in the courtroom as to weather our case was indeed viable but Peters knowledge and expertise was strong and this was explained clearly to the magistrates before they made their decision.
