I qualified as a solicitor in 2000 and have many years’ experience in employment law, gained principally in private practice and in employer organisations. I joined Kilgannon & Partners LLP in December 2021, following its acquisition of specialist employment law firm, Springhouse Solicitors where I worked for eight years. My passion to specialise in employment law started whilst working as a junior solicitor in corporate law when asked to advise established clients on business sales and a tribunal hearing. I work for employees in the public and private sectors and for SME employers and owner managed businesses. I use my technical skills and experience to secure the best outcomes for my clients in disciplinary and grievance matters, and settlement agreements. I also assist employers by providing professional advice and practical guidance in relation to employment contracts, redundancies, changing terms and conditions and day-to-day HR matters. I provide practical advice to employees about their employment rights including reasonable adjustments for disabilities, flexible working, family rights and how to enforce them. Tribunal proceedings are very much a last resort. When appropriate, I use my 20+ years’ experience of managing tribunal cases to deliver results for my clients by taking a proactive approach and using principled negotiation. Reported case: Bickerstaffe v Royal British Legion 2018, ET: Following submissions, the case is notable because the tribunal saw no reason why the principle of compensation for personal injury in unlawful discrimination claims under the Equality Act 2010 could not apply to s.48 Employment Rights Act 1996 whistleblowing detriment claims and awarded the Claimant compensation for personal injury caused by the Respondent’s conduct after whistleblowing. In conjunction with Essex Court Chambers, I am currently bringing a claim in the European Court of Human Rights on behalf of her client (a former employee of a Foreign Embassy in London) that the State Immunity Act 1978 (as amended) is in incompatible with her right to a fair trial (Article 6 of the European Convention on Human rights "ECHR" and right not to be subject to discrimination (Article 14 ECHR), since our client is precluded from bringing any claim in the Employment Tribunals.

Settlement Review

Having received a settlement letter from my employer, I engaged with Louise to review and she assisted me in making a counter claim. Although it was not successful we did get an increased offer which I accepted. I am most grateful for the advice and assistance.

Approachable, kind and wise.

When I experienced the trauma of discrimination and being unfairly dismissed, Louise Maynard’s professionalism, knowledge, and determination ensured the best possible outcome for me in a settlement agreement, therefore avoiding the need to take my ex-employer to court. She is like a trusted friend who will tell you what you need to hear, not what you want to hear, and will guide and support you through the roughest of times. Simply put, she is phenomenal.

Employment

Blank Bullet

Although the firm of Solicitors were recommended by a top media lawyer my Solicitor had a steep learning curve understanding the background to my case. I was involved in a 6 month long Grievance Case with my employer. Eventually the Solicitor opted to seek a settlement with my employer and fired an email with the heading "without prejudice". One of the company directors, simply ignored the email and treated it like a blank bullet. The Solicitor was unable to negotiate and was not effective. This however, did not stop the Solicitors increasing their fee from 2,500 to 4,500

I reached out to Kilgannon late in the process for employment advice through no fault of my own, I might add, but was given excellent support from the outset as we worked towards tight time constraints. The guidance received was second to none with a methodical approach throughout and legal rights and obligations outlined making the experience easy to understand. Well done to Louise and her team! Therefore, I have no hesitancy in recommending Kilgannon to friends and family going forward. Thank you!
