Charity disputes cover governance, administration and governance failures within charities, including issues between trustees, beneficiaries, members and sponsors, as well as disputes over charitable property, asset use and fundraising. A solicitor in this area handles disputes arising from breaches of trustee duties, mismanagement of funds, conflicts of interest, and challenges to charitable schemes or decisions by regulators. They draft pleadings, prepare evidence, seek orders or schemes from the High Court in the Chancery Division, and help with applications to the Charity Commission or court to resolve governance or administration problems affecting a charity’s purposes.
What a solicitor handles in these matters
The solicitor coordinates evidence gathering, drafts statements of case and applications for schemes or directions, engages with the Charity Commission (or its successors) on regulatory matters, and negotiates or applies for court orders to protect charitable assets, prioritize beneficiaries, or reform governance. They may liaise with trustees, beneficiaries, donors, and regulatory bodies, and oversee schemes that alter charitable governance, administration, or property arrangements to prevent or remedy mismanagement and to safeguard charitable purposes.
