In Scotland, transferring equity is carried out through a disposition to change title in the Registers of Scotland and, if needed, a disposition to the purchaser following settlement terms. A Scots solicitor drafts and completes the disposition, secures any lenders’ consent, and arranges registration in the Register of Sasine or the Land Register, as appropriate. They liaise with the client, other owners, and the lender to finalise title, liabilities, and any duties, including duties or tax implications under Scottish law.
