This work covers breaches of leasehold covenants and other lease terms in England and Wales, including how a leaseholder can be held to account and how a landlord enforces covenants. A solicitor in this area helps assess whether a breach has occurred, what relief or remedies are available, and what steps to take to protect the client’s position. It covers drafting or responding to notices, negotiating remedies, and, where necessary, pursuing or defending court or tribunal proceedings.
Where a solicitor protects your position
Breaches can involve failed covenant performance, nuisance, misuse, or non-payment of service charges or ground rent. A solicitor advises on the consequences and deadlines, prepares and serves formal notices (such as notices to remedy or forfeit where appropriate), gathers evidence, liaises with managing agents or freeholders, and represents the client in court or in leasehold dispute proceedings. The work also covers the potential for forfeiture, damages, or injunctions as appropriate to protect the client’s leasehold position.
