Shared ownership lets buyers purchase a stake in a home (often with a housing association partner) and pay rent on the remaining share. A solicitor explains eligibility, arranges the purchase of the initial share, and liaises on leases, mortgage offers, and staircasing to buy additional shares. They draft or review the lease, service charges, and ground rents, and help with transfers when you buy more of the property or sell. The work depends on the terms of the shared ownership scheme and the property’s title.
The solicitor handles lease terms, the mechanics of buying a stake, mortgage documentation, and the staircasing process, ensuring compliance with the scheme rules, mortgage conditions, and lender requirements. They also review charges, rights of way, and any restrictions impacting occupancy or resale.
