Poor Case Management for Personal Injury Claims

I had an accident in August 2021. The police were satisfied that the 3rd party was at fault. However, to date, Lyons Davidson has failed to obtain the Police report from the accident.

Because of their failures, a couple of weeks ago, after reviewing the dash cam footage on my car, they , without any justification attempted to apportion blame on me. Despite numerous concerns over the handling of my case, they have also failed to commence an internal investigation.

I have now lodged my complaint to the Solicitors Regulation Authority and the Legal Ombudman as my case will be time barred in 6 months.

Lyons Davidson Solicitors - A company you need to AVOID.

My recent experience with Lyons Davidson Solicitors was absolutely horrendous. I believe that as a company they are self-serving people without integrity or any respect for human beings who come to them for help.

Like so many others I knew off Lyons Davidson only because they are LV’s (Liverpool Victoria) panel solicitors who are providing “legal advice” to LV’s customers.

In a nutshell: when I approached them in March 2022, I was unwell, injured by a dentist and traumatized. According to the terms of my agreement with LV, their solicitor should act in my best interest. Well, I believe, the interest that matters to Lyons Davidson is only their own. They didn’t do as much as to make a single call to help me out off devastating situation I was in. All they were interested in – officially and in writing to me – were their expenses.

They treated me in an unacceptable way. When I asked their qualified solicitor to give me an example of a medical breach of contract. She said: “I AM NOT GIVING YOU ANY EXAMPLES SO YOU CAN FIT THEM IN YOUR CASE.” Thank you for adding more trauma to the trauma I’ve already suffered!

They lied to me constantly. The recordings are missing due to system change, or just not provided because, I believe, they are inconvenient to Lyons Davidson. They pretended my case was recorded in their system as a “clinical negligence” case when it was recorded as “contract” case. To be clear: two different teams deal with those two kinds of cases.

They haven’t sent me documents they are obliged to send to me by law, either. Please make sure they send you forms that will inform you of your right to cancel their services within 2 weeks. AN ACCTUAL PAPER - FORM. They haven’t send me one, and of course I found out about it when it was too late.

Also if something goes wrong please ask them for recordings of all calls immediately!! Or you might hear that they keep recordings for 30 days only.

I have left LV now. Of course, I did. I couldn’t justify staying with them after such an experience with their agent. No – I do not believe they care, they proved to me beyond any doubt that they don’t care for an individual customer. However, I have reported Lyons Davidson to Solicitors Regulation Authority. I do hope SRA cares.

Please note that if you believe that a solicitor is not honest the organisation to contact is SRA - Solicitors Regulation Authority. Legal Ombudsman deals with poor service (for example delays that cost you money) - ONLY.

I believe, there are better solicitors out there. I know it is sometimes difficult to keep your cool if you have been wronged and injured, but you must. Try the “no win, no pay” solicitors first and see what they say. Do your own research!

Not sure how they run this company

I have had a claim going on 15 months. I have had to constantly make contact to move things along, even making suggestions for them to write letters. Within this time 2 of my case handlers have left the company and I have had to go to the extent of making complaints to try and find out who’s dealing with it to get them to make contact and resume working on my case. It’s tiresome. I have no idea how they function or win any cases if this is the normal service provided. I should have been a solicitor and not an accountant as I have had to do most of the work myself.

Just Awful

Just referred my complaint about LD to the Legal Ombudsman. Instructed them in March 2022 via our LV legal cover insurance. Case has just concluded in September 2023 and unfavourably for us. Not quibbling the outcome but boy am I quibbling how LD have strung this matter out simply heightening our stress and anxiety. The last 18 months or so of our lives have been spent micro-managing LD to do their job. Plus when the Case Handler rang my husband to inform him that the company we were pursuing for compensation had put themselves into liquidatin hence no chance of us recouping our £10k losses, the Case Handler ended the call saying: ''Have a lovely day''. I kid you not. LD= Soul Destroying.

Money their only motivation, no concern for documented truth

This review is for the Bristol branch.

I am making this review on behalf of a friend. I’ve been helping my friend in a claim of professional negligence against a solicitor who represented them in court, my friend being the Defendant in court.

My friend claimed on her home insurance and ARC Legal put forward Lyons Davidson to review the claim. ARC say their solicitors provide a clear and transparent service. Unfortunately, Lyons Davidson do not live up to that claim by far and they have wrongly stated that the chances of success with the claim are low. The basis of their assessment is extremely flawed.

Lyons Davidson have made myriad errors in their assessment. Their letter of advice only dealt with the last 25% of the case history and they have taken a clearly fraudulent claim against my friend at face value, failing to note at least 17 fraudulent points by the Claimant (documented, not hearsay). I have written to the Lyons Davidson solicitor responsible for reviewing my friend’s claim but they stated:

“I will not be undertaking any substantive work unless and until I have some certainty that I will be paid.”

They have made errors and want more money to put those errors right. The response has been arrogant, to say the least. If you buy faulty goods, and can prove it, you don’t have to buy another in order for the faulty goods to be corrected but you do with Lyons Davidson.

In total, Lyons Davidson have had 4 opportunities to get their facts straight and correct their serious mistakes but they have refused on all occasions. The list of their errors and omissions is quite extensive and includes failing to note that the solicitor who represented my friend in court prevented, in writing, my friend from submitting witness evidence, at the same time submitting witness evidence to the court themselves that was fabricated (NB: this is not speculation, there are documents proving this that Lyons Davidsons have omitted to read despite their letter of engagement stating that they would read everything in the relevant file).

The Lyons Davidson solicitor says they have 30 years’ experience. I’ve been able to read for over 60 years and am capable of understanding how fraudulent the claim was against my friend. The law also sees me capable of acting on a jury (I have done jury service twice, several years apart) and can easily assimilate facts and know when someone is being very dishonest, particularly when that dishonesty is so very clearly shown in documents that Lyons Davidson have ignored.

Lyons Davidson’s lack of a suspicious mind and naivety has led them to make serious errors and they have repeatedly refused to correct those errors. They have documents that prove what I say but they have ignored them and now they want money to put their serious mistakes right.

The truth about the claim against my friend is in the 75% of the documents that Lyons Davidson have in their possession but which they have refused to look at. It really is quite easy to see the dishonesty of the claim against my friend and I find it astounding that Lyons Davidson have not reviewed those documented facts in their possession.

I would strongly suggest that you give Lyons Davidson a wide berth. Our justice system is supposedly designed to ensure fair play; however, with solicitors like Lyons Davidson around (and the one who represented my friend in court), the reality is somewhat different. Money rather than fair play is their motive and they do not care about their clients’ right to justice. My friend has lost over £70,000 and all her inheritance because of negligence by solicitors and not because she has done anything wrong (I can prove that statement, by the way).

Lyon’s Davidson do not respond to emails or messages sent within the 5 days allowed. I am still waiting for them to read a message from the 30th November.
The staff you speak to are not qualified solicitors and when you asked to speak to a qualified solicitor you receive nothing.

We were told that our case had a good success rate by the Solicitor who represented us. 3 months down the line she left the company and our case was passed to a claims handler. The case is a boundary dispute that our new neighbours raised with solicitors. We have lived at our property for 30 years and we have a receipt for the fence in question which was installed in 2005. The claims handler wasn't proactive and weeks turned into with months with nothing happening until our neighbours arranged for contractors to turn up on a Monday morning at 8.30 armed with chain saw and crow bar and removed our fences and have their own installed in its place, very distressing for my husband and I in our mid seventies! All this could have been avoided had the claims handler been more proactive. The culmination is that she now tells us that, we have a new fence, and closing the case as it's now not viable to go to court as it was when they took the case on. They have condoned what is morally and ethically wrong. I dread to think how much they billed our insurance for 'representing us'. All this just because the neighbour (who incidentally is also a solicitor) decided they wanted a new fence where ours had stood for 17 years and raised a boundary dispute to get their own way. Go somewhere else if you want good service and someone who actually does something for you, their client !!
