A representative from Mckeag & Co Solicitors LLP responded to this review
We are very sorry to hear that you are disappointed with the service provided to you in relation to your potential clinical negligence claim. As advised, clinical negligence claims can be very lengthy and complex, therefore we must review the prospects of success at each stage to ensure that we are able to continue under a no win, no fee agreement. We were formally instructed to investigate your potential claim on 30 January 2024 and you provided us with details of your care providers on 27 February 2024. Your claim was then reviewed by two senior members of our team and further information was requested from you to fully assess your claim. On 2 August 2024 you advised that you were unable to provide all of the requested documentation and as such, a decision was made to apply for your medical records to assist with our investigations. Your completed forms of authority were received on 16 October 2024 and records were applied for the following day, 17 October 2024. A full copy of your records was received and reviewed, again by a senior member of our team and it was noted that numerous entries referred to your failure to engage with health services and non – attendance at appointments. As such we regretfully concluded that the prospects of success fell below 50% and that we were unable to proceed with your claim. At no point during your claim have we requested any payment from you and a review of your file shows that regular updates were provided to you at each stage of the claim. We appreciate that we could not reach the outcome that you hoped for and that this will be disappointing to you but regretfully, following investigations and medical research, we concluded that there was insufficient evidence to support your allegations of clinical negligence.
