Lack of Communication

My initial dealings with Jake were very positive, and I was confident the process could largely be left in his hands without the need for regular chasing. From the outset, I explained that my buyers required a speedy transaction. I found a property to purchase very quickly, and there was no onward chain outside of the property I was selling and the one I was buying, effectively a two-house, three-party chain, so I had hoped the process would be relatively straightforward. I appreciate that there are aspects of conveyancing which are dependent on third parties and outside of your direct control. However, there were a number of key requests and enquiries which did not appear to be progressed until relatively late in the process. On one occasion, I specifically asked what issues might prevent exchange taking place the following week but did not receive a response. I then sent a detailed follow-up email on the Monday requesting updates on several matters, and eventually received a reply at approximately 8.30pm on the Thursday advising that Jake was away on holiday. During our exchanges the previous Thursday and Friday, this had not been mentioned. When I queried this, I was advised that holiday dates were included within the footer of the emails. Whilst I appreciate this was technically notified, a more direct communication that timings would be impacted due to annual leave would have been extremely helpful, particularly given the urgency I had consistently communicated throughout the transaction. I also felt that responses often defaulted to the position that the “average house transaction takes four months.” Whilst I understand that may statistically be the case, every transaction differs, and this was a relatively short and uncomplicated chain. There was also a two-week period between exchange and completion, and I still needed to chase for the completion statement the day before completion. The first version issued also contained an error and had to be reissued. Overall, my greatest frustration throughout the transaction was the lack of proactive and meaningful communication. Regular updates, clearer expectation management, and more timely responses would, in my view, have significantly improved the experience.

Hi Mandi Thank you for your review. I did ask for clarification on how my absence affected matters when you raised this point; given I had paid a locum to cover in my absence, and no other clients mentioned this. You did not respond to this point at the time. Regarding the completion statement, as you were porting for a reduced balance, I had asked the Lender for clarification on the early repayment charge before finalising the statement. Rest assured, you would have received a completion statement prior to completion. In relation to the communication, I'm sorry this was your experience. I did try to explain over the telephone that emailing post 17:00 with a request for action or a response that evening is only going to led to frustration on both sides and to avoid stipulating your own deadlines in correspondence as this not how correspondence is dealt with. I went above and beyond to ensure your emails were responded to within 24 hours and more than often within a few hours. I appreciate it can be frustrating for clients when their timescales are not met, however it's not always practical for us to advise on every point preventing exchange or completion where these delays are with other solicitors in the chain, as we do not have full transparency over their file. I did explain the position with the information we had at any given time. The timeframe given was only in reference to the national average to evidence that given your transaction completed within this timeframe, there was no 'delay'. As explained over the telephone, having helped thousands of clients move, we are aware of what points do, or do not, typically cause delays. Your property was subject to two restrictions, one in favour of a management company, and the buyer's solicitor was still undertaking their source of funds checks very close to the exchange and completion, another point we discussed over the telephone at the time. As you have highlighted, there are many moving parts in the chain (however small) and often points outside of our control. There is significant correspondence on both of your files, which is self-explanatory. I fear expectation management was destined to fail given the reluctance to acknowledge the average timeframe and your request for responses outside of typical working hours and self-imposed deadlines. I can only apologise your experience was not as expected and I wish you all the best with your future experiences.
