Acting for 6 successful Claimants in the 4-day trial of Benton and Others v Paes and Others (2023, County Court at Central London), also reported in national newspapers. This case related to a major boundary dispute concerning a 20ft disputed strip, dismissal of a counterclaim for a prescriptive easement and indemnity costs. Gregory is also frequently instructed on urgent High Court injunctive relief. This has involved obtaining a without notice interim injunction to protect an MOD “X” listed site by restraining the landlord from turning off electricity; an interim injunction to restrain acts of trespass and nuisance at another sensitive defence contractor site; an injunction to enforce restrictive covenants against former employees engaged in a cybersecurity company, compromised by undertakings to Court; and a without notice injunction to prevent repeated break-ins to residential tenanted premises. He has a broad civil litigation practice, encompassing loans, guarantees, secured lending, defendant mortgage possession work; contract claims, misrepresentation, professional negligence; landlord and tenant work, both residential and commercial, to include 1954 Act business lease renewal and termination; issues relating to trespass, adverse possession, boundaries and easements; and estate and probate matters. Gregory understands that litigation is expensive, time consuming and stressful and, where possible, looks for opportunities for an early resolution, including by mediation.
