Whilst I don't practice IP any more in days gone by I had some very similar examples - remember the Inter Sun girl on the front cover of the holiday mags, well my clients produced another brown haired rather than blond girl calling her the Sol Girl, and the court said it was too similar. Tosh I said at the time! Maybe the cartoon offended less than calling her the 'Sol Girl'. On another occasion my clients Highland Spring bottle was said to look too similar to a French product called Perrier. How fashions change as it probably wouldn't have worked now there are so many similar examples and a lot less Perrier consumed. But it all goes to show that being smart with a products marketing by using circles or bottles or cartoons carries risks and its a point well made by Liz - again as it all depends whether the consumer could have got the brands mixed up.
