Lynsey has specialised in Family Law since 2015, and has been accredited by the Law Society of Scotland as a specialist in both Family Law and Child Law. She chose to specialise in Family Law in order to help people in challenging circumstances. In her practice, she does her utmost to ensure that her clients not only understand their legal options, but also that they feel understood. Lynsey knows how difficult relationship breakdowns and the issues arising from those can be. She deals with all of her clients with empathy and sensitivity, taking the time to understand their priorities while ensuring they are aware of the law as it applies to their circumstances. This will allow her clients to make informed, empowered decisions about their lives. She is an effective and robust litigator when court becomes necessary, and has extensive experience running court actions in sheriff courts across Scotland and instructing Counsel in the Court of Session. However, Lynsey believes that court is usually the last resort and that positive outcomes can often be reached outside of the courtroom. She is an experienced negotiator who strives to secure the best solution for her clients as amicably and pragmatically as possible, without the need for litigation where appropriate. Where it becomes clear that a court action will be necessary she always ensures that she conducts the case with efficiency, robustness, technical expertise, and in the most economical way possible for her client. Lynsey has extensive experience in all types of Family Law cases, including financial provision on separation and divorce, and cohabitation separations. She has many years’ experience of handling high value and complex financial cases, including cases involving business assets and cryptocurrency, pension sharing, and maintenance payments. In separation cases she regularly assist clients in the negotiation and entering into of separation agreements. Lynsey is also experienced in preparing pre- and post-nuptial agreements for clients who are marrying or have married, as well as pre-cohabitation agreements for individuals who are ready to move in with a partner. Lynsey is also regularly instructed in relation to child residence and contact disputes, often arising as a consequence of a relationship breakdown. She has developed a particular specialism in adoption, surrogacy, and assisted conception and fertility law. Lynsey takes great satisfaction and pride in helping clients on their journey to create or expand their families. This area of law can be complex, and clients can often find the legal processes involved to be daunting. It is important that individuals and couples instruct an experienced solicitor who has a deep understanding of the technicalities of the law in this area and who can also provide the support required. As a child law specialist with extensive experience in the law surrounding family creation, she is well placed to ensure that her clients feel supported, armed with knowledge of the process and the legal principles at play, and as comfortable as possible as she helps them navigate the journey. Lynsey has been invited on numerous occasions to contribute to press publications and discussions in the media in relation to adoption and surrogacy. She has appeared in print in national newspapers, on BBC radio and on STV’s Scotland Tonight to provide a legal perspective on these topics. She has also presented at a focus group at the Scottish Parliament in Holyrood in relation to adoption law, and has regularly delivered training to fellow practitioners and given talks at professional conferences on various aspects of Family Law.
