AVOID AT ALL COSTS

I am a 10 year client of EMG Solicitors Limited under a UK Court of Protection deputyship managed by Emma Mary Gaudern and Jemma Claire Morland. By way of background, I am a permanent resident abroad where I have lived for 13 years, and I was assessed as having mental capacity under local law in 2024, yet the UK deputyship continues. Months ago I informed the deputies via email and WhatsApp of my plans to remain permanently abroad and naturalize in my country of residence. This is a long-considered decision reflecting my 13-year commitment to where I live and to establish it as my permanent home. The deputies acknowledged this but have not adequately planned for the implications on my UK assets, raising serious questions about whether they are acting in my best interests. My investment portfolio has experienced significant losses exceeding £300,000 that have never been properly explained despite repeated requests for transparency. The deputies control over £2,000,000 of my funds yet refuse to provide adequate cost breakdowns or explanations for investment decisions, fees, and charges. When I ask for transparency about how my money is being managed, I get vague responses or silence. Ms. Gaudern and Mrs. Morland are appointed for property and financial affairs only, yet they have repeatedly made decisions affecting my healthcare and personal welfare, which exceeds their authority. When I experienced potential cancer symptoms, they were difficult to contact and released only £300 for urgent medical assessment despite the seriousness of the situation. After my partner died from cancer, they withheld funds for housing and nearly made me homeless during the most difficult period of my life. They contacted my medical insurance provider without my consent, raising serious privacy concerns. They treat my healthcare as a budget item and gatekeep medical decisions based on cost, which is not within their remit as deputies for property and affairs. Following my partner's death, neither deputies extended any condolences or showed basic human empathy. This lack of compassion, combined with withholding funds for her treatment and my related needs, showed a concerning focus on control over care. They essentially treated her as if she didn't exist, which compounded the distress during an already unbearable time. They filed a discharge application but did not serve all relevant documents and cancelled my participation in the hearing against my wishes. The process lacked transparency and prevented proper scrutiny. Now they are requesting the UK Court to exercise authority in a foreign jurisdiction where it has no power, attempting to override local laws on my capacity. This is a troubling overreach that disrespects local sovereignty and legal system, particularly given that I have been assessed as having capacity here and plan to naturalize in my country of residence. I have raised these concerns through appropriate channels. I am seeking independent legal advice in both the UK and abroad regarding discharge of the deputyship, limitation of the deputies' authority, recognition of my local capacity assessment, and implications of my planned naturalization. I would strongly advise others in similar situations, particularly those living abroad with local capacity assessments and plans to naturalize in their country of residence, or those experiencing concerns about deputies exceeding their authority or facing inadequate financial transparency, to seek independent legal advice about their rights and options for challenging or limiting deputyships. The system needs greater oversight to prevent deputies from exceeding their authority and to ensure they act in clients' best interests rather than prioritizing control. EMG claim to dispute everything and to have contacted me privately, but as of 28 January 2026, I have not received any private communication from EMG addressing these specific concerns. The lack of response speaks volumes about their willingness to engage with legitimate grievances.
