Flying freeholds arise when part of a dwelling sits over a neighbour’s property or airspace, creating unusual title and boundary questions. A solicitor in this area investigates how the flying freehold affects ownership, rights of support, access, and liability for maintenance, and checks for restrictive covenants or lease clauses that could impact use, sale or refinancing. They draft and negotiate documents to clarify who is responsible for repairs, servitudes and stubs of title, and advise on how to handle mortgage requirements and disputes with neighbouring occupiers.
The solicitor identifies the decisive risks: that an action or omission could affect ownership, access or structural liability. They explain how the flying freehold interacts with the wider title, ensure any necessary declarations or covenants are in place, and confirm the implications for a mortgage, sale or remortgage.

Fantastic service from MBH and in particular Caroline and her secretaries. Pushed our sale and purchase through in less than 8 weeks which involved a chain resulting in a stamp duty saving for us. Thank you all again.

Melissa Claire and Abbie have delivered my mum’s move brilliantly. Melissa inspired confidence and was efficient, knowledgeable and charming and pushed the exchange through on quite a tight schedule. It could have been very stressful - moving my mum from one side of the country to another - but really hasn’t been. Many thanks indeed!

Tagged solicitor Delicia Campbell
I was recommended Delicia by a friend and was not disappointed. She and her firm were responsive and proactive - I never had to chase them for anything. Although the purchase process had some hiccoughs, I was reassured by their attention to detail and would thoroughly recommend her to anyone else. Possibly not the cheapest out there, but you get what you pay for and I wouldn't want to save on this sort of thing if it meant poorer service. I've heard stories from friends of mistakes in the documents their solicitors provided them, but I had no such experience with Paris Smith, everything was great.
