Setting up a tenancy in England covers creating a legally binding domestic rental arrangement between a landlord and a tenant, including the form of tenancy, the rent, and the rights and responsibilities of both sides. A solicitor drafts or reviews the tenancy agreement, checks references, arranges tenancy deposits with a registered scheme, and ensures notices, inventories and inspections are properly handled. They also guide compliance with right-to-rent checks and the transfer or renewal of the tenancy as needed.
Why this work is usually handled by a solicitor
A solicitor drafts or reviews the tenancy agreement, checks references and eligibility, arranges deposit protection with a government-approved scheme, and prepares or checks inventories and schedules of condition. They advise on notices, renewal or assignment, and coordinate any disputes or enforcement steps with the landlord or tenant, backed by professional conduct and regulatory safeguards.
