She has never met my daughter who is mentally and physically handicapped with rett syndrome with no capacity but when I asked for items for her that she needs to help her in her daily life , wheelchair mobility car ect all I get told is my daughter does not have enough money which I find unbelievable as in the 9 years they have dealt with her finances my daughter has only had peanuts of them and keep refusing items that she really needs . They have allowed her money to accumulate so much that dwp have now stopped her benefits so please can someone make this make sense in my head that she has no funds but yet dwp have stopped her benefits because she has to much money that they have just let accumulated over the 9 years . I have never even spoken with Samantha Hamilton or set eyes on her and neither has my daughter so how can someone make these decisions when they don't even understand my girls needs . How is my daughter supposed to access the community and she has missed out on so much like weddings and family functions because there is no way of getting her to these places without an adapted vehicle . We are taking black cabs everywhere which is costing a small fortune and I am left to buy everything she needs out of my own pocket because it kills me to see her go without when there is no need for this as she had plenty of funds that they refuse her access to . So I'm sorry my advise is to avoid this company if you wish your loved ones to have a good standard of life then go somewhere else because she had taken my poor daughters life away and allows her to live in poverty when there is no need for this . I'm treated like some common crimal and get told that she hasn't got a bottomless money when I ask for things that my daughter actually needs. My daughter has grown out of her wheelchair and her feet are actually falling through the foot rest so when asked to purchase a new one I was told to go to NHS which is around a years waiting list and we did actually go to NHS in March of this year and she got refused because all they can offer her is a basic wheelchair which just isn't suitable for her needs . I have had enough now so will be complaining to everyone that mattes until we can get the power of attorney taken of this company Date of experience: 20 June 2024

We are not able to respond directly to confidential client information. However, we can respond generally. Samantha Hamilton is a Panel Deputy which means that she is appointed by the Court of Protection in cases where an independent person needs to act as deputy to manage finances for individuals needing assistance. Unfortunately, this can be in cases of conflict within a family or where the Court has found that a family member is not able to act as deputy. Deputies are supervised by the Office of the Public Guardian and provide annual reports on management of finances. This includes detailing all income and spending, along with decisions made on behalf of the person. In accordance with the Mental Capacity Act 2005, a deputy must manage finances in a person’s best interests. Family members do not always agree on these decisions, but they take into account the person’s capital, income and age. The deputy needs to ensure that finances are managed to ensure funds are available for future as well as current needs. Reasons for these decisions are communicated, including that sometimes funds are awaited before purchases or final decisions can be made. We are required to ensure that the work we do is undertaken at the appropriate level, so the deputy might not meet the person on a regular basis, but others in the department will be in regular contact and arrange meetings as appropriate and necessary. Face to face meetings can be more difficult to organise when a client is moved a great distance away to be closer to family members.
