Review of My Legal Experience with Stuart Miller Solicitors
From the beginning, my case was complex and unlike any I’d ever encountered. As a professional adult content creator, I faced arrest following a allegation in September 2021, based on what’s known as “conditional consent.” The situation was unique and convoluted: while filming consensual content with a female escort, a misunderstanding over consent conditions—specifically regarding —turned an accident into a serious legal issue.
From the outset, I was transparent with the police, voluntarily sharing messages, photos, and video evidence from the incident. But given my past experience with the justice system, I was deeply apprehensive. Initially, I was represented by Anne Hepburn but as the case grew more challenging I decided to switch firms and contacted Stuart Miller Solicitors, a decision that proved invaluable as the complexities of my case unfolded.
Upon contacting Stuart Miller, I reconnected with Mr. Mohammed Zeb. He immediately remembered me, having represented me as a teenager over a decade ago, and his genuine support was crucial from the start. He quickly connected me with an exceptional solicitor, Victoria Hadjihanna, whose meticulous attention to detail, compassion, genuine care, commitment and unwavering dedication kept me steady through the most challenging periods. Victoria patiently guided me, always explaining each legal step, the arguments we would be using, and the broader significance of those points. This foundation was critical as my case moved toward trial.
When my case finally went to trial in September 2024, my barrister, Margia Mostafah, brought a depth of expertise and poise that transformed the trajectory of the case. Given that my defense centered around proving the accidental nature of the incident and undermining the notion of conditional consent, Margia’s approach to cross-examination was essential.
Key Steps in Cross-Examination and Case Strategy
Margia’s cross-examination carefully addressed each point raised by the complainant, aiming to reveal contradictions in her testimony without attacking her character—a fine line, given the sensitive issues at hand. She opened by confirming that the complainant was a professional worker and asked, “Is your main concern money?” to which the complainant replied, “My main concern is my safety.” This opened a crucial line of questioning: the complainant claimed she only offered protected to ensure safety and prevent infections. However, as Margia pointed out, the complainant’s online profile included an “OWO” ( without) service. This was a pivotal moment, as Margia subtly illustrated the contradiction without directly challenging the complainant’s character. If safety was her top priority, her offering of unprotected services was difficult to reconcile.
In further questioning, Margia turned to another key statement: during the encounter, the complainant stated, “ is acid; it messes up your pH balance.” This was not only scientifically inaccurate— is alkaline, not acidic—but also added to the contradiction regarding the complainant’s expressed concerns about safety and infection. When asked why she made this comment, the complainant avoided answering directly, further undermining her credibility without a character attack. By asking pointed, relevant questions, Margia built a foundation that cast doubt on the complainant’s claims without appearing aggressive.
Legal Issues: Conditional Consent and Character References
The central legal question revolved around the concept of “conditional consent.” The complainant alleged that she had set boundaries around , which I had supposedly violated intentionally. However, as we consistently maintained, there was no such agreement; any assumptions around contraception were based on the professional context and prior discussions. Victoria and Margia worked tirelessly to frame this as a performance error rather than a deliberate act, making the case that the accidental nature of the pre- negated the argument for conditional consent violation.
When the prosecution attempted to introduce a previous conviction to imply a propensity for such actions, Margia and Victoria argued that, given the case’s complexity, allowing this would likely bias the jury against me unfairly. The judge ultimately agreed, ruling that the focus should remain on the specific evidence presented in this case, which was a significant win.
Another potential pitfall arose concerning an altered STI document. Though unrelated to the specifics of consent, the prosecution argued that the document represented a form of deception, which might influence consent. However, Margia argued that, according to Section 76, a deception has to relate to the “nature or purpose” of the act to nullify consent. Since the altered document didn’t pertain directly to the nature of the act itself, the judge ultimately ruled that it should be excluded from consideration as grounds for vitiating consent.
A Crucial Moment: Addressing the Complainant’s Gender Identity
One particularly sensitive issue involved the complainant’s gender identity. Partway through the case, I learned that the complainant was a transgender woman—a fact unknown to me at the time of the incident. For me, as a heterosexual man, this information was deeply impactful and made me feel deceived, as it influenced my ability to make an informed choice. Although I wanted this to be addressed in court, Victoria and Margia advised a cautious approach to avoid appearing as though we were questioning the complainant’s character or identity, which might invite the court to admit prior convictions as a “bad character” reference.
Instead, Margia found a nuanced way to weave this element into her cross-examination by focusing on the complainant’s comments about pH balance. She framed her questions to subtly hint at a discrepancy between biological and neo-vaginal anatomy without directly referencing transgender status, and the judge allowed the question to stand. This skillful strategy allowed us to highlight the specific concerns around health and safety, indirectly making the jury aware of the issue without explicitly stating it. This, in turn, strengthened the argument that the complainant’s reaction may have stemmed from factors unrelated to any prior agreements.
Verdict and Closing Reflections
After the evidence and cross-examinations were presented, the prosecution attempted to paint my actions as part of a larger, intentional scheme to deceive the complainant—an argument the jury found unconvincing. The judge provided clear instructions to focus on the specific evidence, and after approximately 6 hours of deliberation, the jury returned a unanimous “Not Guilty” verdict. This outcome not only restored my faith in the justice system but was also a testament to the incredible work of my legal team.
