Challenging councils within care law covers disputes with local authorities over social care assessments, funding decisions, and safeguarding or detention cases that affect adults and children. A solicitor in this area drafts and files applications, responses and evidence, and represents a client in proceedings against a local authority in the High Court or the Court of Protection, as well as in related tribunals. They negotiate care packages, challenge eligibility determinations, and push for timely reviews when services or accommodation are refused or ended. The work is shaped by statutory duties on councils and the urgency of safeguarding concerns.
