This area covers planning for disabled beneficiaries through special needs or discretionary trusts set up in a will or during lifetime, with the aim of preserving benefits while providing for the person's needs. A solicitor drafts the trust terms, appoints and guides trustees, identifies appropriate assets to fund the trust, and advises on eligibility for means‑tested benefits. They liaise with benefit authorities as needed and ensure the arrangement stays compliant with the relevant scheme rules and regulatory duties. The work is especially shaped by benefit requirements and family considerations.
The client’s position is protected by safeguarding eligibility for means‑tested benefits and avoiding disqualifying transfers. A solicitor provides professional oversight through setting clear terms, ensuring proper administration, and handling reporting or changes in circumstances to preserve entitlement to benefits.

Tagged solicitor Paul Baker
I used Paul to draft my Will which was relatively complex because I wished it to create, if necessary, a vulnerable person trust for my wife who is in 24 hour nursing care and unable to look after herself. I then wished the residual estate to be divided between family and other personal beneficiaries and charitable bequests. Paul took great care to understand my wishes and then to explain the draft Will and associated Letter of Wishes. All done speedily and sympathetically.
