Commercial property matters include: • Business lease renewals; advising on and drafting notices in accordance with section 25 and section 26 of the Landlord and Tenant Act 1954; • Forfeiture – court proceedings and peaceable re entry; • Recovery of rent arrears, demands and court proceedings; • Dilapidations; • General lease advice and disputes. Other matters include; contested adverse possession claims, easements, boundary disputes, rectification, covenants, nuisance, trespass. Whilst there is reference to court proceedings in the above, Rhoda takes a commercial view on matters and encourages, where possible, alternative dispute resolution. This can take many forms, but she has found that it can be most effective through without prejudice correspondence and mediation. Court proceedings should be seen as a last resort and alternative dispute resolution a preferred option in the interest of early resolution to save clients additional time, stress and costs.

Advice for Landlord with difficult tenant
