Pulled over by the police with Automatic Number Plate Recognition on their patrol car flagging up no insurance, (subsequently, insurance was found to be correct), was roadside tested with a drugswipe which proved positive and was arrested and taken to a Police Investigation Centre where blood was taken for analysis. Notified nearly 6 months later that the blood was over the limit for THC and was to appear at Magistrates court 2 months later.
Scoured the web for the best legal team and eventually having talked with many we talked with Hilary & Mathew at Kenway Miller who reassured us that they and their team were at the very very top of their game and believe me they are.
Magistrates court came along and a competent Barrister guided us through the day. Pleading Not Guilty, a trial date was set for 4 months later. With 2 weeks to go, the trial was vacated because of a lack of court resources and the trial was rearranged for 6 months later.
Six months later, with the trial imminent, the CPS had still not disclosed all their evidence to the defence despite being directed to do so by the original Magistrates some 10 months earlier. As a result, Kenway Millers forensics team still had not had the opportunity to check all the toxicology reports on the blood samples.
The day before the trial the CPS disclosed that the prosecution’s main witness, the arresting officer, would not now attend as they were busy elsewhere and that they would be applying for an adjournment of the trial. On the day of the trial, was represented by the brilliant barrister Mr Lucas. Mr Lucas’s knowledge of the court procedures, his presentation around the non-disclosure of the evidence and his arguments concerning the late notification of non-attendance of the prosecution’s main witness eventually led to the magistrates conferring for what must have been 30 seconds before dismissing the application for an adjournment and the case was dismissed.
I cannot emphasise enough that Kenway Miller are the team to go to for support for any motoring offences – Hilary, always at the end of the phone, in control and giving reassurance on any concerns, Mathew, again always available with his case management and in-depth knowledge of the legal system and processes, the toxicology team analysing what reports had been produced and barrister Mr Lucas with his brilliant analytical skills, legal knowledge & presentations.
