However, on the basis of what you have said in your review it appears likely that we were instructed by you in relation to a property transaction and that we were unable to comply with our obligations under the UK's Anti-Money Laundering (AML) Regulations. It is rare for us to have to withdraw from acting and a decision to do so is usually taken by by our compliance team, which operates at arm’s length to independently assess and evaluate potential money laundering activity, and doing so is an obligation imposed on us by the AML regulations. If, as seems likely, this is the case, your review sadly contains information which is misleading, as we contacted you to explain that these are the reasons for us having to withdraw. We also explained that our decision to decline to act further for AML reasons is not a judgement that you have acted unlawfully or that you would not be able to proceed with the matter if instructing another firm. We therefore encouraged you to seek legal assistance elsewhere as it may be that another firm will take a different view. Unfortunately, it is not always possible in such cases to provide full details as doing so could be a breach of our obligations under the AML Regulations or compromise our compliance processes, expose sensitive information or breach the confidentiality of others involved with you in the transaction, or potentially offer insights that might be misused to facilitate the circumvention of AML regulations. As accredited members of the Conveyancing Quality Scheme (CQS) we adhere to the Protocol designed to facilitate the flow of relevant information, including to the estate agent who is often a central part of the conveyancing process. However, we will only have informed them that we are unable to continue to act but that another firm may be happy to do so. They will understand that there are various reasons that this may be the case and arrange to put you in touch with another firm who may assist. We understand that our decision to withdraw may be disappointing, and we apologised for any inconvenience this may cause and suggested that another firm may take a different view and be happy to proceed.
