Service Charge Recovery covers disputes over demands for maintenance and service charges in leasehold and shared-property settings. It involves ensuring charges are reasonable, correctly calculated and properly administered under the service charge provisions in leases and the Landlord and Tenant Act 1985 and related legislation. A solicitor in this area drafts and serves demands, reviews accounts, negotiates with managing agents or freeholders, prepares responses to challenges, and, if needed, pursues decisions in court or in the First-tier Tribunal (Property Chamber) to secure a fair outcome for the client.
The solicitor handles the technical calculation of charges, the application of statutory protections, and the procedural steps to challenge or recover fees, including reviewing service charge accounts, agreeing or disputing estimates, and representing clients in disputes before the relevant tribunals or courts. They interpret leases, advise on reserve funds, sinking funds, and major works contributions, and manage disclosure and documentation to support a claim or defence.
