In Scotland, the counterpart to construction and development contracts is handled under Scottish civil practice with pursuer and defender, sheriff court or Court of Session proceedings where disputes arise. A solicitor in this area drafts and negotiates main contracts, sub-contracts, collateral warranties and their funder documentation, addresses payment, extensions of time and risk allocation, and can pursue or defend adjudication or court actions as required under Scots procedure.
