This work covers how an employer handles an employee who is not meeting the required standards of performance, and the steps taken when capability is in doubt. A solicitor practising in this area will guide the process under employment law, draft and review disciplinary and capability procedures, prepare and respond to evidence, and represent the client at hearings. The focus is on ensuring fair assessment, proper notice, and lawful, proportionate action in pursuit of a resolution that protects the client’s position and helps manage performance issues.

“Myself and business partner sought advice from Mogers Drewett after finding ourselves in a contract dispute. Throughout our dealings with Mogers Drewett we felt like we were in a safe pair of hands. Given the stressful circumstances, we were thoroughly impressed with Sean and Annie. They were professional, communicative, empathetic and able to convey the complex topic in an easily understandable manner. We were delighted with the outcome Mogers Drewett were able to achieve and wouldn't hesitate to recommend them in the future. ”

“Great service form start to finish. With the help from Hannah Ross and Sarah Sowden, they managed maternity cover and a very tricky and slow opposition. All whilst being considerate of my incurring costs and an emotional and stressful situation. For me however, it's always the human approach they take and for this, I'd happily always recommend to anyone and everyone. ”
