Underperformance in the workplace covers struggles with meeting job standards or expectations, and the steps an employer uses to address it through capability and performance procedures. A solicitor practising in this area helps clients draft and apply a performance improvement plan, gather evidence of work issues, and navigate warnings, reviews, and potential dismissal processes. They advise on constructive steps, communicate with the employee, and prepare material for employment tribunals if escalation occurs, focusing on fair process and lawful outcomes.

“I am very happy with the service and advice Omar and Sabeena provided me throughout this process. They made things simple, from the moment I contacted the firm the communication was excellent which led to a speedy resolution and the sound and transparent advice provided to me helped me immensely. If I have any legal matters in the future I would use Curwens firm and will be recommending the firm to friends and family. Thanks again for all the assistance you provided me.”

“Working with Victoria was excellent. She got up to speed with my case very quickly and summarised the position clearly and concisely pointing out some contradictions and missing clauses from the initial draft agreement. Vicky not only provided good advice but was also prepared to listen to my suggestions and support these in the negotiations. Overall I'm really happy with the service and the outcome and wouldn't hesitate to recommend Vicky and BBS Law to friends and colleagues. ”
