The sale of my property proceeded without problems and I therefore conclude that some of the issues experienced with my purchase were due to the seller’s solicitor. Documents concerning my purchase were received in a very random and piecemeal fashion. The title deed was only received with the contracts. Given the restrictive covenants contained in the document, I believe that its existence should have been referenced earlier. Whilst the Conveyancing Assistant was very responsive and helpful, I repeatedly asked questions about right of access, boundaries and so on. I did not want my vendor’s opinion or understanding of the matter. This was a legal query and there was the expectation that the matter would have been dealt with by the solicitor herself. Certainly I would have expected the existence of the title deed to be referenced or referred to in answer to these queries. Instead, I was placed in an unenviable position, when limitations were revealed at the 11th hour. I would also have expected the solicitor to obtain the documents referred to in the mining survey. Apart from asking the vendor, no attempt was made to do so. I felt that the solicitor should be more hands on. Her role seemed to consist of summarising documents at key points rather than offering a personal service. The conveyer belt approach is fine but I engaged the firm to provide legal assistance not just to undertake the requisite admin. Because of the nature of attachment appearing disjointedly at the bottom of e mails, it would be helpful if a list of the attachments could be included at the start of every e mail. This would encourage the scrolling required on occasions to discover them.
