In England, testacy concerns matters when someone dies leaving a valid will. A solicitor helps executors to identify assets, collect them, settle debts and taxes, and distribute the estate to beneficiaries in line with the will. They prepare and file documents with the Probate Registry, arrange the grant of probate, liaise with banks, insurers and landowners, and advise on Inheritance Tax and any trusts or residuals that arise within the estate.
The grant of probate and the administration of the estate determine which assets pass, how debts are paid, and how beneficiaries receive their share. The solicitor’s role includes regulatory accountability, handling probate documentation, and advising on tax exposure and potential claims against the estate.
