Dismissively unrepentant incompetence
Before you consider employing Browell Smith and Co Solicitors please take account of the following information that had I had previous knowledge of would have dissuaded me from contracting them to represent me in a probate dispute. As sole executor to my uncle’s estate who died 01/08/2017 only I can sanction making payments from the estate capital account which at present include invoices of over £12,000 from Browell Smith and Co Solicitors for failing to fulfil a contractual commitment from them to have a permanent caveat removed. During my first meeting with Stephen Browell I pointed out the caveator’s title was not decorously denoted on my late uncles LW&T dated 03/05/2017 he dismissed that as irrelevant even though he knew unless a deed of variation had been signed by all the other beneficiaries within two years of my late uncles death the caveator became an invalid beneficiary information I later used to have the caveat removed as an unrepresented litigant. Whilst under contract to me to have the caveat removed Browell Smith & Co solicitors submitted to the courts a signed affidavit they prepared that the caveator’s legal representation later discovered included two false declarations resulting in the original grant of probate being withdrawn for re-revocation, that has resulted in the property owned by my late uncle now having an additional outstanding council tax arrears bill of £21,271.85 to pay that would not have existed had those critical errors not been included in the affidavit they composed and presented to the courts. During the period between the original grant of probate and its call back for re-revocation this company advised me to wait a period of one year before sanctioning them to distribute the estate a request I complied with informing them I believed they had made an miss calculation in the capital account statement as it did not include the bank account details of Money account where my late uncle had deposited £38,729.99 which if left unclaimed will be lost in perpetuity. I have a solicitor’s witness statement Stephen Browell of Browell Smith and Co Solicitors was provided with the file containing a document originally produced by McKenzie Bell solicitors that contained all the bank account and sort codes relating to my late uncles estate. I have documented proof of the grammatical and numerical errors they included in the signed affidavit produced by them and submitted to the courts and empirical proof that without just cause on 3 occasions Browell Smith and Co refused to release the funds relating to my late uncles estate held in their client account and the title to my late uncles home. They are also withholding a receipt preventing me recovering the £2000 I paid 8 years ago for my uncle’s funeral. So on behalf of my late uncle’s estate to prevent this company treating future clients in the same manner I'll be having the dismissively unrepentant Gillian Imrie and Ruth Alison Browell prosecuted through the courts for obstructing the administration of my uncle’s estate a crime punishable by imprisonment and fine. The hearing ruled in using client monies as he did, “he caused harm to the reputation of the profession “In addition to the £20,000 fine and costs of £25,000, conditions imposed on his practising certificate meaning Mr Browell could no longer practise as a sole practitioner or be the sole authorised person at a firm, be a COLP or COFA, act as a sole signatory to any client or office account, or have the sole power to authorise transfers from any account.
