This area covers applications to relocate a child to another country and related disputes, within the English family justice system. It includes how to obtain court permission to move, or how to resist relocation, when a child is at risk of being moved abroad. A solicitor in this area advises on the best evidence to gather, drafts and negotiates applications under the Children Act 1989, prepares supporting statements, and represents the client in court hearings in family court proceedings, often coordinating with Cafcass and international authorities to ensure the child’s welfare remains protected during cross-border moves.
What a solicitor handles in these matters
Relocation cases require detailed welfare assessments, cross-border considerations, and the involvement of foreign authorities where applicable; the solicitor handles the drafting of applications, gathering third-party evidence, instructing experts (e.g., social workers, mental health professionals), liaising with Cafcass, and representing the client at hearings in the Family Court. They ensure compliance with international child protection norms and document the potential impact on the child’s welfare and stability.
