This area covers how social housing is allocated and how transfers between council or housing association homes are handled. It includes eligibility for council accommodation, the local housing authority’s allocation scheme, bid or measurement of need, and the process for moving a household from one property to another. A solicitor in this field drafts and reviews applications, helps gather evidence of need (income, medical or family circumstances), and advises on the rights and limitations within the Housing Act and the allocation framework.
The decision to grant or refuse a transfer or allocation can be outcome-determinative for a household’s housing security, affecting eligibility for priority housing, access to adapted properties, and timing of move. A solicitor’s role includes explaining deadlines, securing interim housing where needed, challenging unlawful refusals, and ensuring compliance with the local authority’s scheme and statutory homelessness duties.
