My late mother’s NHS claim for CHC, Continued Health Care.
At the grand old age of 99, in January 2023, my mother passed away. She had been a full-time resident in a Sussex care home for 6 1/2 years. She had received a good standard of care in the home, throughout her stay. For the last 3 years of her life, her osteoarthritis became pronounced, and she was virtually immobile. She quickly lost weight, and became bed-bound. The lady had several significant health care needs.
In 2016, the family was obliged to sell the family house in Eastbourne, to begin to pay for the care home fees. In 2018, I had a tussle with the Sussex CCG (predecessor of the ICB) who initially decided that mother was not eligible for Funded Nursing Care (FNC). This decision was appealed, and the CCG subsequently decided in retrospect that FNC was applicable, and FNC was backdated to her arrival in the care home in 2017.
Soon after her passing in January 2023, I contacted Farley Dwek (FD) to assist with a potential NHS CHC claim. Andrew Farley was most helpful, and he introduced me to Gill Cropper, a senior case manager at FD. Gill has been really great. She has made a big convoluted extended claim as straightforward as possible, always on hand with top quality, relevant advice.
In early 2023, I paid a once-off fee to FD, and commissioned a Retrospective Review of my mother’s potential case. I am so glad I did this, as it has formed the basis of the CHC claim itself. We decided to make a CHC claim for the final two years of mother’s residency. By dint of perseverance, Gill has put together a substantial piece of medical and legal research , despite the care home health records being patchy and some of poor quality.
However, in October 2025, the ICB came to the conclusion that there was no eligibility for CHC in these two years. They had their reasons for this. But with Gill Cropper leading, and with her extensive needs evidence to hand, she decided to appeal the ICB 2025 conclusion. We are of the opinion that several of the domains have been under valued by the ICB.
Earlier in April 2026, we met with the ICB, via microsoft Teams online - this meeting is called a Local Resolution Meeting, or LRM. We discussed the various CHC domains, and Gill made it clear where and why we are disagreeing with the ICB case. Gill had prepared for this meeting very well. She had a real grasp of the headline banner material, as well as the details supporting my mother’s case. I could not have attended the LRM on my own.
I have thanked Gill for her continued high quality support. We are hoping for a positive appeal outcome this time round.

Excellent CHC Assessment Support
Having experienced a full CHC assessment for our dad and funding being declined, we wanted to be better prepared when mum's health sadly deteriorated and she was put forward for a full CHC assessment.
I initially spoke to Andrew, who explained a variety of ways in which the company could help. He was very pleasant to converse with and there was absolutely no pressure to commit. Upon discussions with family we decided to use the advisory phone call whereupon we had an in-depth discussion with Maq, whose advice was excellent. I would absolutely recommend Farley Dwek if you are seeking CHC funding, particularly as it is often declined when it should not be. We were pleasantly suprised that mum was awarded the funding and we are certain the fact that we had mentioned we had used Fawley Dwek, contributed to this decision. We had prepared well for mum's assessment, however upon talking to Maq it really highlighted several things we hadn't considered, which enabled us to be fully armoured with precise evidence during the CHC meeting. The cost of getting advice is so minimal in comparison to the extortionate fees for nursing homes, I would absolutely say do it, to give your loved one the best chance of getting the funding if they meet the criteria. Had we been better prepared for dad's we are sure he would have received funding too. Sadly he passed away and the 5 months he was in a nursing home cost £20,000. Seek advice to ensure you are fully prepared for these difficult meetings.

We received good service from this company, although ultimately the service came from an independent self employed ex Nurse Assessor / Manager instructed by them. To this end, I suspect the fees were a little high. That being said, the service we received from that Assessor was superb. I can’t speak highly enough of them. Their knowledge, experience & professionalism were second to none & no doubt assisted us in understanding the process & obtaining the funding. Thank you Maq! I would highly recommend him.

We used FD for help with my Dad's CHC. We started with discussions with Andrew Farley, a partner. The company were responsive and professional throughout. Then we spoke with Maq, a nurse advocate who dug deep into my Dad's health and history. He gave us practical advice and pointed out what the law is, what it requires & how to go about approaching it.
We wanted support at the DST, so were put in touch with another Nurse Advocate, Carla; she was amazing. The experience can be daunting and harrowing at times - I have no idea how we'd have done without her support. She visited my Dad at the nursing home, spoke to him and the nurses - Literally left no stone unturned and was tenacious with it. During the meeting she was constantly taking notes and wasn't afraid to raise objection whenever she felt something was incorrect.
She uncovered some concerning gaps in my Dad's care which we will be addressing to make sure he is being looked after. We'd never have known otherwise.
I realise that getting a solicitor involved for CHC isn't financially possible for everyone, but you're dealing with your family here - You want to do all you can. You can';t guarantee an outcome, but you can at least try. Eventually my Dad was refused full CHC but we got a continuation of his FNC. This was solely down to the nursing home keeping inadequate and contradictory records, which are the ultimate basis for the decision, but Carla even gave them a chance to rectify it in advance, which they chose to ignore. So we can't hold FD responsible for the decision - It's the home's fault.
I can completely recommend Farley Dwek, and if you're lucky enough to get Carla as your Nurse Advocate you're going to be re-assured and feel like you have someone fighting your corner in what is, after all, a rigged match. I wasn't paid for this review and wasn't asked to do it, by the way.

We approached Farley Dwek for help following a CHC funding MDT that left us feeling let down and confused. The administrative team were very efficient and after an initial telephone chat, we very quickly received a call back from Andrew Farley to discuss our situation in more detail. I found Andrew to be extremely professional, reassuring, objective and well-informed. He gave me an honest appraisal of our situation and empathetically addressed our expectations from a position of wisdom and experience. Despite the fact we had not officially appointed his firm at that stage (we were still awaiting the CHC decision), he was very generous and gracious with his time on the phone/emails.
Thanks to Andrew’s guidance, we were able to articulate and feedback our reservations to the CHC and they ended up ruling in our favour. We therefore did not end up having to formally instruct Farley Dwek for representation but our impression was that they were an exemplary firm with judicious invested leadership and noble ethics.

I was helped by a number of people at Farley Dwek recently with a family member's CHC application. They were fantastic - friendly and professional. The application was successful, and I couldn't have done it without them. But even had it not succeeded, I was made aware throughout about the realities of the CHC/CCG system, which sadly - in my opinion - seems to be weighted against the applicant. I went ahead knowing that the outcome isn't always fair. Farley Dwek helped with the huge amounts of stress that go with the CHC process. CHC Process
We received good service from this company, although ultimately the service came from an independent self employed ex Nurse Assessor / Manager instructed by them. To this end, I suspect the fees were a little high. That being said, the service we received from that Assessor was superb. I can’t speak highly enough of them. Their knowledge, experience & professionalism were second to none & no doubt assisted us in understanding the process & obtaining the funding. Thank you Maq! I would highly recommend him.

We approached Farley Dwek for help following a CHC funding MDT that left us feeling let down and confused. The administrative team were very efficient and after an initial telephone chat, we very quickly received a call back from Andrew Farley to discuss our situation in more detail. I found Andrew to be extremely professional, reassuring, objective and well-informed. He gave me an honest appraisal of our situation and empathetically addressed our expectations from a position of wisdom and experience. Despite the fact we had not officially appointed his firm at that stage (we were still awaiting the CHC decision), he was very generous and gracious with his time on the phone/emails.
Thanks to Andrew’s guidance, we were able to articulate and feedback our reservations to the CHC and they ended up ruling in our favour. We therefore did not end up having to formally instruct Farley Dwek for representation but our impression was that they were an exemplary firm with judicious invested leadership and noble ethics.

What a fantastic group of people. I asked for help with a family member’s continuing health care and paid for a consultation - unfortunately the family member passed away before the scheduled call. I emailed to let them know and Angela and Andrew replied with their condolences and a refund within minutes.

After contacting Farley Dwek solicitors I was put in touch with Angela Armstrong a retired nurse who was going to talk me through the process of my up and coming MDT meeting with the NHS and to assist me in my preparation. It was the best thing I could have done. I was given good advice and felt confident to take on the team that I was due to meet in a couple of days.On the day of the meeting I used Angela’s advice and I can now tell you that we were successful in getting NHS funding for my wife for the future. The advice received through discussions and reading the excellent book, and the regular posts of tips and hints, enabled us to obtain CHC funding for my Father in Law. This allowed him to remain at home for the last 18 months, with 24 hour live in care keeping him safe and comfortable. He died peacefully in his own bed, surrounded by things which were familiar to him. We are incredibly grateful for all the support and information provided.
