This area covers the situation where a homeowner lets out a room or a part of their home while they continue to live there, known in plain language as becoming a live-in landlord. It involves choosing between a lodger licence or an assured informal tenancy, and navigating the rights and duties that arise for both the occupier and the homeowner. It depends on the type of agreement and how it is drafted, documented and enforced. The process may be shaped by tenancy rules, eviction rights and safety obligations.

Where a solicitor protects your position

The key decision is whether the occupier has a licence or a tenancy, which affects eviction rights and the level of protection. A solicitor can advise on drafting a clear licence or tenancy agreement, serving lawful notices, and handling issues such as rent payments, deposits, and potential disputes. They can also assist with safety standards, rights of access, and resolving conflicts without escalating to court proceedings when possible.

I have the highest opinion of Ian Cranefield as he was the only one of three solicitors that actually answer my question and did not tell me that I should have done something that could have put my home in a precarious position.
