This work covers how people obtain or change their home within England, focusing on social housing allocations, transfers between properties, and the practical steps needed to secure rehousing. A solicitor in this area helps applicants with housing applications, responses to local authority or housing association decisions, and issues around homelessness duties and displacement. They also handle mutual exchanges, transfers between dwellings, and appeal rights if a parent, carer or household member’s needs change the home required.
Solicitors in this field instruct on housing allocations schemes under the Housing Act 1996 and related regulations, prepare and respond to homelessness determinations, assist with mutual exchange applications, and negotiate or challenge transfers where a tenant’s circumstances change. They review tenancy terms, coordinate with local authorities and registered social landlords, and ensure that deadlines, evidence requirements and appeal routes are followed to protect the client’s housing position.
