Discretionary disqualification covers when a court may ban a driver from the road even if the offence does not automatically require disqualification, or to extend a ban beyond any mandatory period. A solicitor practising in this area helps by preparing mitigation, evidencing fitness to drive, and representing the client at sentencing or disqualification hearings in the Magistrates' Court or, where appropriate, the Crown Court. The work matters because a disqualification abruptly restricts access to employment, family logistics and daily life, and can have long-term consequences for a person’s driving record and finances.
The solicitor handles factual and legal questions about fitness to drive, possible restrictions, and the evidential basis for a discretionary disqualification. They assemble reports (medical, vocational, character), liaise with the DVLA, draft mitigation, and argue proportionality to avoid or minimise disqualification where possible.

Tagged solicitor Paris Phillips-Morris
I used Paris as my solicitor for a Drink-driving offence I had committed. I found her and the rest of the team at Ashtons Legal LLP very professional and also supportive in assisting me with it. I would have no hesitation recommending her services.
