Exceptional Hardship covers applications to avoid or suspend a driving disqualification when losing the ability to drive would cause serious hardship for the applicant or other people, such as family members who depend on transport. A solicitor in this area will scrutinise the facts, gather supporting evidence, and present a structured case to the Magistrates’ Court or Crown Court showing why a disqualification would be exceptionally harsh or unjust. This work also includes seeking a restricted or occasional licence where appropriate to maintain essential travel.
The decision determines whether a disqualification happens, which could affect employment, caring responsibilities and daily life. The solicitor collects medical letters, employer statements, and other proof to demonstrate extraordinary consequences if driving is prohibited, and explains how a restricted licence could meet essential needs while maintaining road safety. The professional role is to present the evidence clearly and argue the exceptional hardship case within the legal framework governing disqualification.

Tagged solicitor Paris Phillips-Morris
I used Paris as my solicitor for a Drink-driving offence I had committed. I found her and the rest of the team at Ashtons Legal LLP very professional and also supportive in assisting me with it. I would have no hesitation recommending her services.
