Rent suspension covers temporary reductions or pauses in rent due under a commercial lease, typically in response to downturns or exceptional events. A solicitor in this area helps negotiate concessions, drafts variation documents, and applies to the landlord for a rent holiday or reduced rent with service charge adjustments, rent reviews, and other lease terms aligned to the concession. They coordinate with the landlord, tenant, and professional advisers to secure a formal variation or deed of amendment that records the suspension and its duration and conditions.
The solicitor handles the provisions, documentation and any related negotiations and filings required to implement a rent suspension, including drafting the deed of variation, clarifying the effect on rent reviews, service charges and compliance with the lease covenants, and dealing with lenders or funders when a security or assignment is involved.
