Pre-employment checks cover the measures an employer takes before offering a job, including identity, right to work in the UK, and verification of qualifications and references. A solicitor practising in this area helps draft and review policies, advise on compliance with data protection and equality laws, and support or challenge disclosure checks and safeguarding requirements. They supervise the handling of DBS disclosures, verify criminal record information, and manage disputes arising from background checks to protect the employer and the applicant alike.

Why this work is usually handled by a solicitor

Checks rely on regulated processes and disclosures; a solicitor provides guidance on regulatory requirements, data handling, client accounts, and potential disputes arising from criminal checks or references, ensuring compliance and mitigating risk for the employer.
