Expat divorce covers divorce where one or both parties live or have assets overseas, or where the divorce involves cross‑border elements. A solicitor in this area helps clients navigate English family law while coordinating with foreign jurisdictions. They draft and issue petitions, mediate settlements, and obtain or enforce financial orders and declarations of rights across borders. This work matters because international moves can affect jurisdiction, asset division, and parental rights, and timely, properly drafted orders are crucial for finalising lives overseas.
The solicitor handles the provisions, structures and procedures that cross borders: overseas assets, foreign divorce recognitions, international maintenance claims, and dealing with foreign courts or tribunals. They manage the interaction of English law with international private law, negotiate financial settlements, prepare court documents such as consent orders and applications for leave, and coordinate service and enforcement across jurisdictions.
