This work covers whether a will is legally valid and enforceable under England and Wales law, including properly drawn and witnessed testamentary documents and the resolution of any challenges or defects that could render a will invalid. It also includes matters that arise when a will fails to meet formal requirements or when a beneficiary or potential beneficiary disputes its validity. In practice, it focuses on ensuring the deceased’s wishes are recognised and carried out in probate.

“I cannot recommend Georgina Vanden Berghe and the team at Martin Tolhurst highly enough. We were on a very tight timeline to get our wills completed, and despite being busy, it felt like she dropped everything to make sure our deadlines were met. Although our wills themselves were fairly straightforward, the Inheritance Tax (IHT) implications were much more complex. Over the course of two meetings and numerous emails, she took the time to meticulously collate all the necessary data and present her findings in a clear, accessible way. She broke down complex legal and tax terms effortlessly. I have never dealt with a solicitor who was so down-to-earth, open, honest, and approachable. Her assistant was also incredibly friendly and efficient, ensuring the entire process ran seamlessly. An outstanding, stress-free experience from start to finish.”
