In England, this area covers the preparation and registration of a Lasting Power of Attorney (LPA) to allow a chosen attorney to manage your financial affairs or health and welfare decisions if you lose mental capacity. A solicitor drafts the document, ensures it complies with the Mental Capacity Act 2005 and the Office of the Public Guardian processes, verifies the donor’s capacity, and advises on safeguards and possible alternatives.

Why this work is usually handled by a solicitor

Solicitors ensure the LPA document is correctly drafted, witnessed, and registered, addressing common errors that could invalidate the instrument. They explain the roles, duties, and limits of the attorney, potential conflicts of interest, and the interplay with deputies if capacity has already deteriorated, while providing professional indemnity and regulatory accountability.

Tagged solicitor Charlotte Fairfax

We instructed Charlotte Fairfax to sell a property . She and her assistant Eleanor were absolutely fantastic . Technically excellent with the sale being unregistered and a probate sale. Extremely proactive and responsive . We could not fault them.
