Conspiracy to rape in England and Wales includes agreements between two or more people to commit rape, even if the intended act is not carried out. A solicitor in this area reviews police and CPS disclosures, advises on potential defences, and represents the client at court hearings from charging through trial. They may negotiate with prosecutors on evidence, disclose exculpatory material, and prepare a robust defence strategy tailored to the allegations and the strength of the evidentiary record.
Where a solicitor protects your position
The offence hinges on the existence of a plan to rape and the intent to pursue that plan, which can be proven by communications and actions, even if the act never occurs. A solicitor ensures timely disclosure, challenges evidence gaps, and uses procedural tools to protect the client's position, including examination of witnesses and potential trials in the Crown Court.
