Scarring Injury covers claims where a person has permanent visible skin damage from accidents or medical treatment, recognised as a distinct personal injury in England and Wales. A solicitor in this area gathers medical evidence, obtains dermatology and plastic surgery expert reports, and pursues compensation for pain and suffering, disfigurement, impact on appearance and confidence, loss of amenity, and future care or earnings adjustments. They draft and advance pleadings, negotiate settlements, and may represent the client at court or in insurance settlement discussions, ensuring compliance with time limits and applicable schemes.
The specific decision points involve confirming liability and the extent of disfigurement, and securing damages for non-pecuniary losses and any future care needs. The solicitor protects the client’s position by ensuring accurate medical evidence, appropriate professional reports, and proper handling of settlement negotiations or court actions.
