This area covers requests for criminal records checks under the Disclosure and Barring Service (DBS) for employment, volunteering or regulated activity. A solicitor helps prepare applications for basic, standard or enhanced checks, explains what information will appear and whether it can be filtered, and advises on handling any adverse disclosures. They review disclosures for accuracy, challenge incorrect entries, and coordinate with employers and safeguarding bodies to ensure compliant recruitment or ongoing suitability.
What a solicitor handles in these matters
The solicitor handles the specific provisions and procedures for criminal record checks under the DBS, including identifying which level of check applies, gathering identity verification documents, liaising with the DBS and the Disclosure Unit, and navigating any disclosures that affect employment or licensing obligations. Complexities arise where information is disclosed, restricted or disputed, or where checks intersect with safeguarding requirements.
