Internship rights in England cover the legal position of people who undertake work placements or internships, including whether they qualify for pay, holiday, and other basic employment protections. A solicitor in this area drafts and reviews placement agreements, checks eligibility for the National Minimum Wage and any exemptions that may apply, and advises on matters such as holiday entitlement, working hours, and lawful dismissal or disciplinary steps. They also help with disputes over pay, recognition of internship status, and any risk of exploitative or unlawful practices during a placement.
The right decisions can prevent misclassification of a placement as a job, which carries risks of back pay, penalties, and regulatory action. A solicitor provides guidance on compliant pay and entitlements, the correct use of interns’ personal data, and protections against unlawful dismissal or discriminatory treatment during or after a placement.
