Driving without a valid MOT is a criminal offence when a vehicle is used on public roads without a current test certificate. A solicitor practising in this area handles cases where the driver is charged with presenting a vehicle to the road without a valid MOT, or with failing to maintain a valid certificate. They assess the police or DVSA evidence, review exemptions, and prepare a defence or mitigation for court proceedings. The work often hinges on whether the vehicle was dangerously unroadworthy or if the certificate had lapsed due to clerical issues.
What a solicitor handles in these matters
The solicitor handles the specific provisions governing MOTs, the relevant sections of the Road Traffic Act and related regulations, evidential issues from the DVSA and police, and any exemptions or transitional rules. They map the chain of custody for the certificate, challenge timing, and review potential defences such as exemptions, device failures, or administrative errors that led to a lapse in the MOT.
