This area covers how a person’s prior criminal convictions affect current or future matters, including disclosure in employment, licensing, or professional applications, and any limits on when convictions must be disclosed. A solicitor helps with advising on spent convictions, applying for disclosure exemptions, and navigating background checks, background history gaps, or record corrections. They may also advise on how prior offences influence trial strategy, sentencing options, or probation and rehabilitation requirements.
What a solicitor handles in these matters
A past conviction can create limits on disclosure, eligibility, and credibility in proceedings or applications. A solicitor provides concrete guidance on statutory exemptions, record corrections, rehabilitation periods, and the management of disclosure obligations under the Rehabilitation of Offenders Act 1974, the Police Act regimes, and related safeguarding or licensing regimes. They explain procedural steps, potential waivers, and how to present the record to minimise practical and legal impact.
